Currently, agricultural workers who work for employers having 25 or fewer employees are entitled to overtime compensation after their 10th hour of work per day and for the first 8 hours worked on the seventh consecutive day of work – as opposed to receiving overtime if they work over 8 hours in a day. These laborers receive double time compensation only for hours worked over 8 on the seventh consecutive day of work – as opposed to receiving double time compensation for hours worked over 12 in a day.

All that is about to change, though, starting January 1, 2022, due to Assembly Bill 1066, which was signed in 2016 and established a schedule for changes to daily and weekly hours after which agricultural workers would receive overtime pay. 

 

Assembly Bill 1066

Starting January 1, 2022, employers with 25 or fewer employees will be required to pay their agricultural workers overtime after 9.5 hours every day and over 55 hours in a week; thereafter, on January 1, 2023, these employers will have to compensate their farm laborers overtime pay after 9 hours in a day and over 50 hours in a week; on January 1, 2024, employees would have to be paid overtime for every hours worked over 8.5 in a day and over 45 in a week; until January 1, 2025, when farm laborers working for employers with 25 or fewer employees would finally receive overtime compensation for every hour worked over 8 in a day and over 40 in a week.

Effective January 1, 2022, these agricultural workers will have to be compensated double time for hours worked over 12 in a day.

In addition, agricultural employees are protected by the Labor Code provisions governing meal and rest periods.
