The Program: This program on Pre-Mediation presents two acclaimed international leaders in

legal innovation and mediation. They will focus on the increasing realization of the importance of

detailed preparation – by mediators, attorneys and their clients – in order to enhance the

chances of settlement at mediation. Messrs. Imperiale and Sankary are the co-authors of the

article “Mediation Before the Mediation: The Important Role of a Pre-Mediation Session”,

published in late 2022 on Mediate.com. (Copies of the article will be included in the program

materials.) Our two panelists provide a detailed roadmap of the various steps that the mediator,

parties and counsel should take before the mediation if they want to advance the cause of

settlement come mediation time.

The Speakers:

Marco Imperiale: Marco is a lawyer and mediator and the Head of Innovation at a leading

international law firm, LCA, based in Milano, Italy. In 2009 he received his J.D. degree,

graduating summa cum laude, from the Università di Bologna – the world’s oldest university,

founded in 1088. After receiving a prestigious Fulbright Scholarship in 2015, he attended

Harvard Law School, where he received his LL.M. degree, participated in Harvard’s Mediation

Program, and became co-founder of the Harvard Italian Law Association. He works as mediator

for civil, intellectual property and commercial disputes in Italy, and also serves as Head of

Innovation for his law firm, LCA. Marco remains a Visiting Researcher in Legal Design and

Legal Innovation, and a Teaching Fellow, at Harvard Law School’s Copyright X Program. He

also is a prolific author on intellectual property and the use of innovation and legal design in the

legal community.

Myer Sankary: Myer graduated from Harvard Law School in 1965 and has been a member of

the California Bar for over 55 years. He is a Past President of the Southern California Mediation

Association. His practice areas were in business, real estate, litigation, probate and estates. He

has mediated hundreds of litigated and non-litigated cases for over 25 years with a high

resolution rate. He is often appointed as trustee in highly conflicted estates. In 2013, he founded

the non-profit organization, the Mediation Center of Los Angeles, which was awarded two

contracts in 2018 with Los Angeles Superior Court to provide low-cost mediations, with

experienced attorney-mediators, for all civil litigants who file cases in Los Angeles County. For

the past 10 years, Myer has served as MCLA’s President, Board member, and Program

Director. Myer has extensive experience with online mediations, which he started using in 2018,

and has trained a number of mediators on the use of Zoom for online mediations. Myer has

taught courses in mediation at the University of Southern California, and Pepperdine Law

School, among other prominent venues. In 2002, he received the American Bar Association’s

Donald Rikli Lifetime Achievement Award, for outstanding services rendered on behalf of

lawyers in California and the nation. Myer has provided extensive services to the legal

profession as Chairman of the Executive Committee of the Solo & Small Firm Section of the

State Bar of California, and has been responsible for promoting extensive educational

programs.
